The following are instructions on how to address loans formerly held by Taylor, Bean and Whitaker. Please click on the link that applies to you:
FOR MERS MEMBERS:
If your Taylor, Bean and Whitaker loan names MERS as Mortgagee, the loan must be registered on the MERS® System before any other transactions can take place. Click here to see if your loans have been registered on the MERS® System.
- If the loan is registered,
locate the name of the servicer on the MERS® System.
- If the servicer is your organization: proceed according to your regular business procedures.
- If the servicer is Taylor, Bean & Whitaker: send a request to Taylor, Bean and Whitaker asking them to transfer the MIN(s) to the servicer who acquired the servicing rights to that particular MIN. Please note, the servicer who acquired the servicing rights must also confirm the transfer.
- If the loan is not registered, you can either:
- Register the MIN on the MERS® System and complete any subsequent transactions, or
- The member that purchased the loan can register the MIN on the MERS® System and complete any subsequent transactions.
In either case, the loan must be registered on the MERS® System within ten days of purchasing the loan. Once the loan is registered, the servicer listed on the loan is responsible for completing any further transactions.

FOR NON-MERS MEMBERS: Register the loans on MERS today!
If your Taylor, Bean and Whitaker loan names MERS as Mortgagee, the loan must be registered on the MERS® System before any other transactions can take place even if you are not a MERS member. Failure to register the loan will result in our inability to forward any service of process we receive for this loan as the mortgagee recorded in the land records.

- If the loan is registered, locate the name of the servicer on the MERS® System.
- If the servicer is Taylor, Bean and Whitaker and you subsequently sold the loan to another MERS member: send a request to Taylor, Bean and Whitaker asking them to transfer the MIN(s) to the servicer who acquired the servicing rights to that particular MIN. Please note, the servicer who acquired the servicing rights must also confirm the transfer.
- If the servicer is Taylor, Bean and Whitaker and you subsequently sold the loan to a non-MERS member: send a request to Taylor, Bean and Whitaker asking them to deactivate the MIN on the MERS System via transfer to non-MERS member and prepare, execute, and record the subsequent assignment from MERS to the purchaser.
- If the loan is not registered and was subsequently sold to:
- Another MERS member, contact the purchasing MERS member to promptly register the loan on the MERS System. The purchasing MERS member must register the loan on the MERS® System within ten days of purchasing the loan. Once the loan is registered, the servicer listed on the loan is responsible for completing any further transactions for the loan.
- A non-MERS member, send a request to Taylor, Bean and Whitaker to promptly register the MIN, and then deactivate the MIN on the MERS® System via transfer to non-MERS member. You should also remind Taylor, Bean and Whitaker to prepare, execute, and record the subsequent assignment from MERS to the purchaser. If the loan is not registered within ten days and is purchased by a non-MERS member, please contact the MERS Product Performance Department.
